    EMPLOYEE ACTIVITY RELEASE

    In consideration of being permitted to use the gym facilities and participate in any fitness-related activities (the “Activities”), I agree to the terms of this Employee Activity Release (the “Release”). I understand that participation in the Activities involves an inherent risk of personal injury and property damage, and I am voluntarily electing to participate. I understand that Snowflake Computing, Inc. and its subsidiaries (“Snowflake”) does not require or encourage me to participate in the Activities. I know of no medical reason why I should not participate in the Activities. I have reached the age of majority and have signed under my own free will, and I am suffering under no conditions or previous injuries that would prevent my safe participation in the Activities or potentially lead to my injury or the injury of another participant.

    In the event of an emergency, I authorize Snowflake or the operating facility to secure from any licensed hospital, physician, or medical personnel any treatment deemed necessary for my immediate care. I agree that I will be responsible for payment of any and all medical services rendered. I understand that alcohol may be served at this event, and I acknowledge that Snowflake requires me to act responsibly during and on the way to and from the Activities with regard to my alcohol consumption.

    I assume full responsibility for any risks of loss, property damage, or personal injury, that I or my property may sustain as a result of the Activities, whether caused by the negligence of the Releasees (defined below) or otherwise, and agree indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including attorneys’ fees and court costs, they may incur arising out of or related to my participation in the Activities. I hereby release, waive, discharge Snowflake and its affiliates, officers, agents, or employees (together, “Releasees”) from any and all liability, claims, demands, actions, and causes of action of any kind or nature arising out of or related to any loss, damage, or injury, including death, that I or any of my property may sustain resulting from my participation in or in any way connected with my participation in such activities, regardless of whether such loss is caused by the negligence of the Releasees and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, and covenant not to sue the Releases based on the same. It is my express intent that this Release bind my family members, spouse, heirs, assigns, personal representatives, and anyone else entitled to act on my behalf to the extent they act on my behalf, and is deemed as a release, waiver, discharge, and covenant not to sue the Releasees.

    This Release shall be construed in accordance with the laws of the State of California and that any mediation, suit, or other proceeding relating to this Release and any activities covered hereby must be filed or entered into only in San Mateo, California and the federal or state courts of San Mateo, California. Any portion of this Release deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the Release as a whole to the full extent authorized by law.

    GUIDELINES FOR FITNESS CENTER USAGE

    Completion of the Snowflake Recreation Participation Waiver is required prior to using the Snowflake Fitness Center.

    All participants using the Fitness Center are expected to follow these guidelines and policies. Failure to comply with these guidelines may result in the loss of Fitness Center use privileges.

    • Guests are not allowed to use the fitness center.
    • Harassing, intimidating or violent behavior will not be tolerated.
    • Members need to “work-in” on the equipment.
    • Vulgar or offensive music is not permitted in the Center.
    • Equipment needs to be wiped down after use.
    • Weights need to be returned to the racks after use.
    • Weights should not be dropped on the floor.
    • Weights are not allowed to rest against the mirrors.
    • Dirty towels need to be disposed of appropriately.
    • During peak hours (or while others are waiting) limit your time on the treadmill, stair climber, elliptical, etc. to 30 minutes.
    • Wear proper attire. Shirts (that cover the upper torso area) and closed toed shoes are required during workout sessions.
    • The member is responsible for the security of all personal property brought into the locker room or fitness center.
    • Snowflake and the Fitness Center Operator are not responsible for any member's belongings that are lost or stolen in the locker room or fitness center.

      In addition, please do the following:

    • Report any equipment problems to a Fitness Center Operator.
    • Return all borrowed equipment to the front desk after use.
